The Car Shop Trailer Sales Warranty:

All of our manufacturers offer different warranties on their trailers, stated below. At the time of purchase the warranty information will be handed to you. Please be advised the warranty is between you and the manufacturers. We will assist in all warranty claims clerically to speed up the process on behalf of our customers.

All warranties MUST BE pre-approved by the manufacturers: No Exceptions !! In most cases photos must be provided.  Prior Written Consent Required and Return of Defective Parts in some cases. Tire related warranties require information off the tires be provided and in most cases tires must be left for pick up by the warrantier.
No reimbursement will be made to any dealer or owner for repairs made without the prior written consent of THE MANUFACTURER.


Pre – Owned Trailers:
All pre owned trailers sold from our dealership are sold “AS IS”, meaning no warranty, unless otherwise stated at the time of purchase.

Manufacturers Stated Warranties Overview:
Below is a briefing on the warranties of some of the manufacturers we carry, all details are NOT listed. For a complete detail listing request your sales person to scan or fax one to you.


Aluma All Aluminum Trailers:
Plant Location: Bancroft, Iowa
Aluma warrants that its product will be free from defects in workmanship and material for a period of five (5) years. The warranty period starts the day of purchase by the ORIGINAL owner. Any unit that proves to be in material and/or workmanship under normal use, and such unit is returned to Aluma and under their inspection is determined to be defective, the unit will be repaired without charge to the ORIGINAL purchaser. Any repairs other than by the factory will be paid for only with prior approval from Aluma. The warranty shall be void where the unit has been subject to misuse, neglect, alteration, modification, accident or where repair part or actual repairs have been supplied and/or performed without Aluma authorization. Loading in access of gross vehicle load ratings states on the certificate plate will invalidate any and all warranties. Normal wear items will not be replaced due to wear (items include but are not limited to, bearings, brakes, brake linings & hinges). Paint warranty (90) days does not cover wear, deterioration and/or damage from road elements, salt, sand, weather conditions, and/or improper wash solvents.

 

American Made Trailers:

Plant Location: DeLand, FL 

LIMITED WARRANTY:   American Made Trailers, 421 N. Spring Garden Ave., Deland, FL  32720 (Warrantor) warrants to the original consumer purchaser (Purchaser) under normal use in the continental United States will be free from defects in materials and workmanship for three (3) years following the original purchase date on the Premier Line trailers and one (1) year on the Camping Line, Billy Line, Open Car Hauler and Open Utility trailers, subject to the requirements, exclusions and limitations stated below.  If the trailer is rented or used for commercial hauling, this Limited Warranty is null and void.

VALIDATION OF WARRANTY:  In order to validate this Limited Warranty, the original copy of the form on the bottom of the warranty sheet must be completed, postmarked and mailed to American Made Trailers, Warranty Department, 421 North Spring Garden Avenue, DeLand, Florida  32720, no later than ten (10) days following the purchase of an American Made trailer. 

THREE YEAR AND ONE YEAR LIMITED WARRANTY:   Subject to the requirements, exclusions and limitations stated below, the structure of your American Made trailer is warranted to the original retail purchaser against defects in materials and workmanship by American Made Trailers, arising from normal use for three (3) years from the date of purchase on the Premier Line trailers and one (1) year from date of purchase on the Camping Line and Billy Line trailers.  The structure is that portion of the trailer which includes the main frame, consisting of the bottom rails, cross members, side posts and exterior walls, roof rails and bows, and subframe, excluding the floor boards and running gear.

ONE YEAR LIMITED WARRANTY:   Subject to the requirements, exclusions and limitations stated below, all other components of your American Made trailer are warranted to the original retail purchaser against any defects in the materials and workmanship by American Made Trailers arising from normal use for one (1) year from the date of purchase.  American Made Trailers warrants its paint finish to be consistent with industry standards for one (1) year after the date of original purchase, with exceptions of “normal use” limitations set for below and of deterioration due to use or exposure, such as chipping, scratching fading, cracks in caulk seams, road salt or tar, damage by animals, or pressure washing.  Warrantable paint repairs are limited to spot repairs and blending consistent with standards in the trailer industry. 

EXCLUSIONS OF COMPONENTS WARRANTED BY OTHER MANUFACTURERS:  Tires, axles and brake components, springs and suspension components, couplers, jacks, casters, batteries and windows and doors purchased and installed by American Made Trailers are hereby warranted by their manufacturers and are excluded from this warranty.  American Made Trailers manufactures some trailers into which other persons or companies who are not employees or agents of American Made Trailers install living quarters or other interior and exterior features or modifications.  American Made Trailers expressly disclaims and excludes any responsibility or liability for any materials or workmanship in any items installed in your American Made Trailer by any other person or company, including any incidental or consequential damages or contingent liabilities arising therefrom  This Limited Warranty covers only defects in original components which arise from normal use and does not apply if the trailer has been subjected to negligence, accident, abuse, neglect, or overload, or has been repaired or altered without the prior written consent of American Made Trailers.  Normal wear items, including but not limited to doors, struts, lights, bearings, brakes, brake linings, tires, and batteries, will not be replaced due to wear. 

TRANSPORTATION COST EXCLUDED:  Transportation of any trailer to and/or from your dealer or any approved repair facility shall be the responsibility of the trailer owner.  American Made Trailers or any American Made Trailers dealer shall not be liable for any such costs. 

PRIOR WRITTEN CONSENT FOR REPAIRS NEEDED:  No reimbursement will be made to any dealer or owner for repairs made without the prior written consent of American Made Trailers.  Any defective part(s) must be sent by prepaid freight to American Made Trailers in order to qualify for replacement or reimbursement under this limited warranty.

LIMITATIONS AND DISCLAIMERS:    The sole responsibility of American Made Trailers under this limited warranty shall be to repair and replace parts at the American Made Trailers factory or, for a reasonable allowance, at another place, if authorized in writing by American Made Trailers.  All other obligations or liabilities arising out of the failure of any parts to operate properly, are hereby excluded, including but not limited to any damages resulting from loss of use, inconvenience, loss of time, commercial loss, or any type of damages, general or specific, foreseen or unforeseen, unless applicable State Law provides otherwise.  This warranty is expressly in lieu of all other express warranties and representations.  American Made Trailers makes no representation or warranty of any kind, express or implied, with respect to American Made Trailers whether as to merchantability, fitness for a particular purpose or any other matter.  No one, including an authorized American Made Trailer dealer, is authorized to make further or additional warranties on behalf of American Made Trailers.  All implied warranties of merchantability and fitness for intended use are limited to warranty periods above, unless any applicable State law provides otherwise. 

WARRANTY CLAIMS PROCEDURE:  (1.) The bottom portion of the warranty sheet must be mailed to American Made Trailers, 421 North Spring Garden Avenue, DeLand, Florida  32720.  (2.)    Within five (5) days after discovering a problem with your American Made trailer, return your trailer to an authorized American Made Trailers dealer for inspection.  Dealers are responsible for fixing minor problems without charge to you or American Made Trailers.      (3.)   If your dealer cannot repair the problem free of charge and you want to file a claim under this warranty, the dealer must send to American Made Trailers, by fax or registered letter, a Limited Warranty claim form, together with all required information, within ten (10) days of your discovery of the defect.                                                                               (4.)  American Made Trailers will respond to the claim as soon as possible, but no later than thirty (30) days after receipt of claim with a written approval or denial.  American Made Trailers will not reimburse any claimant for any adjustment or repair without this prior written approval.  American Made Trailers reserves the right to not pay unreasonable costs for replacement or repair of defects in your American Made trailer.                                         (5.)  American Made Trailers shall elect to remedy defects in materials and workmanship caused by American Made Trailers by repair or replacement by either the American Made Trailers factory or another qualified location, upon written consent. 

 

ATC The Aluminum Trailer Company:
Plant Location: Nappannee, Indiana 3 Year Limited Warranty - 5 Year LIMITED Structural Warranty
Excludes the Raven Lite Models

The Aluminum Trailer Company Inc. (ATCI) warrants to the original consumer for a period of three (3) years from the date of purchase the trailer manufactured by ATCI shall be free from manufacturing defects in materials and workmanship supplied and attributable to ATCI. This warranty is non-transferable and is limited to defects in workmanship performed by ATCI only. Other components such as but not limited to tires, wheels, axles, awnings, couplers, generators, hydraulic pumps, jacks, winches, air conditioners, doors, 3M VHB, windows etc are covered by OEM warranties and thus must be filed with the OEM. Also ATCIs warranty does not cover special paints, decals or graphics. The five (5) year structural warranty covers the structural portion of the ATCI trailer shall be free from manufacturing defects in materials and workmanship supplied and attributable to ATCI. The structural portion of the warranty shall include the main aluminum frame and all the aluminum members welded to it, the studs and framing in the walls and roof members. All other items are covered by the standard three (3) year limited warranty.
The ATCI warranty is valid only if the trailer is (a) Returned to ATCI or (b) Returned to a repair facility authorized by ATCI. Reasonable notification must be given for all repairs. A written estimate must be provided to ATCI prior to work being performed. Loss of time, inconvenience, loss of use of trailer, rental or substitute equipment, loss of revenue or other commercial loss is not covered by this warranty. This warranty does not cover freight to or from ATCI for repairs. The original purchaser of the warrantor’s product and any person to whom the product is transferred, and any person who is an intended user or beneficiary of the product shall not be entitled to recover from the warrantor any consequential or incidental damages resulting from any defect in the product. Damages include loss of use of the trailer, loss of revenues or any other commercial losses, subsequent use of rental equipment, loss of time and inconvenience.
This warranty is void if the product has been abused, overloaded, inappropriately loaded, neglected or misused in any way. ATCI reserves the exclusive right to determine whether or not the consumer has misused the product. The purchaser must notify the warrantor (ATCI) at the address below of any defect within fifteen days after it is, or should have been discovered. Purchaser must complete and return to ATCI the warranty form at the bottom to obtain warranty service within 30 days of purchase.
The 3M VHB tape used for bonding the seams on the screwless exterior has a limited temperature rating. In extreme situations, if units exceed this temperature, this may cause problems with the screwless exterior. If problems should arise with the screwless exterior, ATCI will apply rivets or screws in the walls as a part of our warranty procedure.

Big Tex:
Plant Location: Odessa, Texas
Your Big Tex equipment, which has been manufactured, tested and inspected in accordance with carefully specified engineering requirements, is warranted to the ORIGINAL owner to be free from defects in material and workmanship for the period of one (1) year, except as herein limited, from date of purchase. The obligation of this warranty shall be limited to repairing or replacing any part or parts which, in the opinion of the company, shall be proved defective in materials or workmanship under normal use and service during the one-year-period commencing with the date of purchase. Paint and wood flooring are warranted for a period of ninety (90) days from date of purchase. This warranty does not cover any part or parts which have been damaged as a result of an accident, misuse or abuse. This warranty shall not apply if the trailer has been subjected in loads in excess of its rated capacity.
LIMITATIONS AND EXCLUSIONS
(1) Equipment which has been modified, repaired, or altered in any way without the express written consent of BigTex.
(2) Unreasonable use (including failure to provide reasonable and necessary maintenance).
(3) Tires, axles, axle assemblies, suspension components, or any other equipment which is warranted separately by the respective manufacturers of said components.
(4) Parts not supplied by BigTex.
(5) Certain parts which require replacement in the ordinary course of use due to normal wear.

Carry On:
Plant Location: Lavonia, Georgia
Carry On Trailers, Inc. warrants each trailer to the ORIGINAL owner to be free from defects in material and workmanship for a period of one (1) year, except as may be limited, from date of purchase. 


Down to Earth:

Plant location: Baxley, Georgia.
Down to Earth Trailers warrants products manufactured by it to be free from defects in materials and workmanship for 12 months from the date of manufacture (paint and cosmetics carries a 30 day warranty), under normal use and service. Products are dated both on the Certificate of Origin and on the VIN label attached to the trailer. The sole and exclusive obligation of Down to Earth Trailers is to repair, at its option, free of charge for parts and labor, any part which is defective in materials or workmanship under normal use and service. All returns for credit are subject to inspection and testing at the manufacturer's location before actual determination is made to allow credit.
In case of defect, the trailer shall be returned to Down to Earth Trailers at the dealer’s or user’s expense. Down to Earth Trailers will make the determination and necessary repairs if so determined. Overloading or willful misuse of the trailer will void the warranty. Within five (5) days after discovering a problem with your Down to Earth Trailer, return your trailer for inspection to your Down to Earth dealer where you bought your trailer. If your dealer cannot repair the problem free of charge and you want to file a claim under this warranty, your local dealer must send to Down to Earth Trailers by registered mail a warranty claim form, together with all the required information within ten (10) days of the discovery of your defect. The warranty claim form must list the defective components. All defective parts must be returned prepaid to the manufacturer’s address. In some instances, photos or digital images will be required along with the defective parts. Repairs made at an approved agent of Down to Earth Trailers must first be approved in writing by Down to Earth Trailers. Under no circumstances shall Down to Earth Trailers pay for unapproved repairs or reimburse the end user or dealer for any defective parts that have not been returned to Down to Earth Trailers for inspection. 
EXCLUDED FROM WARRANTY
Down to Earth Trailers does not warrant products not manufactured by it, such as, axles, tires, wheels, couplers, jacks, but assigns to the purchaser any warranty extended by the manufacturer of such products. The warranty is void if the product is altered or repaired by anyone other than Down to Earth Trailers or an authorized agent of Down to Earth Trailers. This warranty is also void if there is a failure to maintain the products as recommended by Down to Earth Trailers and the various manufacturers of various components going in the manufacturer of the trailers. 
Buyer acknowledges that Down to Earth Trailers is not an insurer and assumes no risk for loss or damages or the cost of any inconvenience, transportation damages, misuse, abuse, accident or similar incident.
Down to Earth Trailers gives no warranty, express or implied, of merchantability, fitness for any particular purpose, or otherwise which extend beyond the description on the face hereof. Under no circumstances shall Down to Earth Trailers be liable for any loss of or damage to property, direct, incidental or consequential, arising out of the use of, or inability to use Down to Earth products. Furthermore, Down to Earth Trailers shall not be liable for any personal injury or death which may arise in the course of, or as a result of, personal, commercial or industrial use of its products. 



Horton Haulers:
Plant Location: Eatonton, Georgia
THREE YEAR LIMITED WARRANTY
Horton Vans Inc. (Horton Vans) warrants that each Horton Van trailer operated by the ORIGINAL purchaser under normal use in the Continental United States or Canada will be free from defects in materials and workmanship for three (3) years following the original purchase, subject to the requirements, exclusions and limitations stated below.
The obligation of this warranty shall be limited to repairing or replacing any part or parts, which in the opinion of the factory are defective in materials or workmanship under normal use and service during the warranty period commencing with the date of the first retail purchase. If the trailer is rented or used for commercial hauling this limited warranty is null and void.
Subject to the requirements, exclusions and limitations stated below, the structure of your Horton Hauler is warranted to the original retail purchaser against defects in materials and workmanship by Horton Vans from normal use for three (3) years from the date of purchase. The structure is that portion of the trailer, which includes the main frame, consisting of the bottom rails, cross members, side posts and exterior walls, roof rails and bow, and the sub-frame, excluding the floorboards and running gear.
ONE YEAR LIMITED WARRANTY
Subject to the requirements, exclusions and limitations stated below, all other components (electrical, lights, mechanical jacks, fiberglass, doors, sealants, locks, couplers and paint) of your Horton Van trailer are warranted to the ORIGINAL retail purchaser against any defect in the materials and workmanship by Horton Vans arising from normal use for one (1) year from the date of purchase.
LIMITED PAINT WARRANTY
Horton Vans warrants its paint finish to be consistent with industry standards for one year after the date of original retail purchase, with the exceptions of “normal use” limitations set forth below and of deterioration due to use or exposure, such as chipping, scratching, fading, cracks in caulk seams, road salt or tar, damage by animals or pressure washing. Warrantable paint repairs are limited to spot repairs and blending consistent with standards in the trailer industry.
EXCLUSIONS OF ITEMS WARRANTED BY OTHER MANUFACTURERES
Expressly excluded from this Limited Warranty are any claims related to items that are warranted by their own manufacturer. These items include, but are not limited to: tires, rims, axles, and axle components including, without implied limitation, tow in/tow out and camber on axle; brake components; springs and suspension components; couplers and jacks; and any other items purchased and installed by Horton Vans.

King American, LLC:
Plant Location: Douglas, Georgia
 
LIMITED WARRANTY
King American, LLC warrants to the original consumer purchaser for a period of six (6) years from the date of purchase by purchaser that its trailer shall be free of defects in materials and workmanship attributed to warrantor.  Excluded from the six year warranty are electrical, plumbing, windows, doors, sealant, paint, undercoating and fiberglass parts which are warranted for a one (1) year period from the date of purchase by the original purchaser.  Warranty is non-transferable. 
 
EXCLUDED FROM WARRANTY
Warrantor is not responsible for claims related to: (1) defacing: scratches, dents, chips, tears on any surfaces not caused by warrantor; (2) routine maintenance; (3) damage from unauthorized repairs, abuse, misuse, or neglect; (4) damage caused by improper hitch ball or tow hook up; (5) component parts covered by separate supplier warranty.  King American, LLC reserves the right for final determination whether or not the product has been abused or misused.
 
WARRANTOR’S OBLIGATION
Warrantor shall elect to remedy defects in materials and workmanship caused by warrantor by repair, replacement or refund, if replacement or repair is not possible.  All defective products shall be delivered to warrantor’s address unless prior written approval is obtained from warrantor.  Warrantor may select another qualified location for the repair to be completed.   Warrantor will not be obligated, in any way, to pay for repairs made without its specific approval.  All costs incurred in shipping or delivery of product for warranty service shall be borne by purchaser.  Warrantor shall remedy defects within a reasonable time, not to exceed sixty (60) days after delivery purchase. 
 
PURCHASER’S OBLIGATIONS
Purchaser must notify warrantor of any defect within fifteen (15) days or after it is, or should have been discovered.  Purchaser must complete and return warranty card within fifteen (15) days of purchase to obtain warranty service.  Purchaser must pay all service, towing and transportation charges incurred to obtain warranty service.
 
DISCLAIMER OF CONSEQUENTIAL AND INCIDENTAL DAMAGES
The original purchaser of warrantor’s product and any person to whom the product is transferred, and to any person who intended user or beneficiary of the product shall not be entitled to recover from warrantor any consequential or incidental damages resulting from any product defect, including loss of trailer, revenue, or other commercial loss, use of rental equipment or loss of time and convenience.
 
LIMITATION AND DISCLAIMER OF IMPLIED WARRANTY
Warrantor expressly limits the duration of all implied warranties of merchantability, fitness for a particular purpose and other implied warranties to the warranty period of six (6) years.  The warrantor expressly disclaims all implied warranties after expiration of warranty date.  No person has the authority to enlarge, amend or modify this warranty.
 
DESIGN CHANGE
Warrantor reserves the right to change the design of its product from time to time without notice or obligation to make corresponding changes to previously manufactured. 
 
This warranty gives you specific legal rights.  No action to enforce this warranty shall be commenced later than six (6) months after the discovery of any defect or after the expiration date of warranty period. 
 

Legend Manufacturing, Incorporated:
Plant Location: Eureka, MI

5 AXLE- 15 FRAME - 25 FLOOR - 25 ROOF LIMITED WARRANTY

Legend Manufacturing, Inc. (Warrantor) warrants to the ORIGINAL CONSUMER PURCHASER (Purchaser) for a period of Fifteen (15) YEARS from the date of purchase by Purchaser (WARRANTY PERIOD), that it's TRAILER (the frame) shall be free of defects in materials and workmanship attributable to Warrantor. In the case of a bonding agent failure, Legend Manufacturing, Inc. will install a mechanical fastener (i.e., rivets, screws, etc) as part of our repair process if deemed necessary.
Excluded from this fifteen year warranty are electrical, plumbing, sealant, bonding,  paint, undercoating, and fiberglass parts which are warranted for a ONE (1) YEAR period from the date of purchase by the Original Purchaser. Legend's (1) pc. aluminum roof will have a warranty period of 25 years from corrosion and deterioration.

THINGS EXCLUDED FROM WARRANTY
Warrantor is not responsible for claims relating to the following: (1) defacing: scratches, dents, chips, tears, and defacing on any surface not caused by Warrantor; (2) routine maintenance; (3) damage from unauthorized repairs, abuse, misuse, or neglect; (4) damage caused from improper hitch ball or tow vehicle hook up; (5) component parts covered by separate Supplier Warranty such as warranties of the manufacturer of tires, axles, jacks, couplers, doors, windows, light fixtures, etc. These warranty claims must be presented to their respective component manufacturer for warranty service. Legend Manufacturing, Inc. reserves the right for final determination whether or not the product has been abused or misused by the Purchaser.


WARRANTORS OBLIGATION – HOW TO GET WARRANTY SERVICE
Warrantor shall elect to remedy defects in materials and workmanship caused by Warrantor by repair, replacement or refund, if replacement or repair is not possible. All defective products shall be delivered to Warrantor's address listed above unless prior written approval is obtained from Warrantor. Warrantor may, as its option, select another qualified location for the repair to be completed. Warrantor will not be obligated, in any way, to pay for any repairs made without it's specific approval. All costs incurred in shipping or delivering the products for warranty service shall be borne by the Purchaser.


PURCHASERS OBLIGATION
Purchaser must notify the Warrantor, at the above address, of any defect within fifteen (15) days after it is, or should have been, discovered. Purchaser must complete and return to Warrantor the attached Warranty Card within fifteen (15) days of purchase to obtain warranty service. Purchaser must pay all service, towing, and transportation charges incurred to obtain warranty services.
 
DISCLAIMER OF CONSEQUENTIAL AND INCIDENTAL DAMAGES
THE ORIGINAL PURCHASER OF WARRANTOR'S PRODUCT AND ANY PERSON TO WHOM THE PRODUCT IS TRANSFERRED, AND ANY PERSON WHO IS AN INTENDED USER OR BENEFICIARY OF THE PRODUCT SHALL NOT BE ENTITLED TO RECOVER FROM WARRANTOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES RESULTING FROM ANY DEFECT IN THE PRODUCT. DAMAGES INCLUDES LOSS OF USE OF TRAILER, LOSS OR REVENUES OR ANY OTHER COMMERCIAL LOSSES, SUBSEQUENT USE OF RENTAL EQUIPMENT, LOSS OF TIME AND INCONVENIENCE

Motiv:
Plant Location: Nappannee, Indiana
Motiv Trailers warrants to the ORIGINAL consumer purchaser for a period of three (3) years from the date of purchase by purchaser (warranty period), that it’s trailer (the product) shall be free of defects in materials and workmanship attributable to warrantor.
EXCLUDED from this three year warranty are electrical, plumbing, windows, doors, seals, sealant, paint, undercoating, and fiberglass parts which are warranted for a one (1) year period from date of purchase by the ORIGINAL purchaser.
EXCLUDED FROM WARRANTY
Warrantor is not responsible for claims relating to the following:
(1) Defacing ; scratches, dents, chips, tears, and defacing on any surface not caused by warrantor
(2) Routine maintenance
(3) Damage from unauthorized repairs, abuse, misuse or neglect

WARRANTOR’S OBLIGATION
Warrantor shall elect to remedy defects in materials and workmanship caused by Warrantor by repair replacement or refund, if replacement or repair is not possible. All defective products shall be delivered to Warrantor’s address listed above unless prior written approval is obtained from warrantor. Warrantor may as its option, select another qualified location for the repair to be completed. Warrantor will not be obligated, in any way, to pay for any repairs made without its specific approval.

FIVE YEAR SUBFLOOR STRUCTURE LIMITED WARRANTY

The FIVE year limited warranty covers workmanship and materials for structural subfloor elements that comprise the trailer frame on select models.  Structural subfloor elements consist of the metal frame support tubes, rails, floor cross-members and A-frame.  Limitations and exclusions are listed in the Warranties section below. Models covered by the limited FIVE year warranty are: CargoSport, ConQuest, Legacy, Midway, Pursuit, Shadow, Silver Arrow and Summit.


THREE YEAR LIMITED WARRANTY
Warranties: Pace American, Inc. warrants the original owner that the PACE AMERICAN trailer will be free from defects in material and workmanship for the period of three (3) years except as herein limited, from the date of the first retail purchase, provided all stated conditions and exclusions are met and satisfied.  The obligation of this warranty shall be limited to repairing or replacing any part or parts which, in the opinion of Pace American are defective in materials and workmanship under normal use and service during the three (3) year period commencing with the date of the first retail purchase. 


ONE YEAR LIMITED WARRANTY
Electrical components, lights, mechanical jacks, fiberglass, doors, sealants, seals, locks, couplers and paint are warranted for a one (1) year period from the date of the first retail purchase, subject to the limitations contained in this limited warranty.


WARRANTY REGISTRATION AND REQUESTS
 A warranty registration certificate is included with the dealer paperwork. The dealer must fill out and mail this certificate to the factory within ten (10) days after making delivery of the trailer.  All warranty requests must be presented to PACE AMERICAN and proper arrangements must be made and approved by the Customer Service/Warranty department prior to any work being done.  All warranty repairs must be made at the PACE AMERICAN factory, unless prior written approval is obtained from the Customer Service department before said repairs begin.  In certain cases, the PACE AMERICAN factory may, as its option, elect to have warranty work performed in the field by a qualified repair shop.  PACE AMERICAN will not be obligated in any way to pay for repairs made without specific approval in advance, repairs made in any manner other than approved by PACE AMERICAN, labor charges in excess of those deemed reasonable by PACE AMERICAN or any parts bills in excess of the cost if PACE AMERICAN had supplied those parts.  Labor and parts charges for covered warranty work are limited to the amount charged by PACE AMERICAN for such labor and/or parts.  Except as described in this limited warranty, PACE AMERICAN will not pay any other charge or expenses including, without implied limitation, any charges for overtime labor, service calls, towing charges or transportation costs.  Such charges or expenses are the responsibility of the customer and will not be paid for by PACE AMERICAN. 


ITEMS NOT COVERED BY WARRANTY
1.  Items covered by another warranty, except as to proper installation:
axles and axle components including, without implied limitation, tow in/tow out and camber on axles;
tires: present a claim for tire adjustments to a tire dealer who handles the brand in question and is authorized to make adjustment, rims, air conditioners, awnings, winches, electric jacks, hydraulic jacks, food service equipment, beverage equipment, water heaters, refrigerators, landing gear, stove/cook top, microwave, furniture, water pump, TV, VCR, stereo equipment, and furnaces.
Subject to the other items of this limited warranty, PACE AMERICAN warrants the proper installation of the above listed items. 
2.  Tow vehicle wiring.
3.  Damage or wear caused by unreasonable use or failure to provide reasonable or necessary repairs or maintenance.
4.  PACE AMERICAN will not be responsible for work performed or options installed by others.  Customer will be charged for any labor, material or parts resulting from work performed or options installed by others, including without implied limitation: graphics, special awnings and hydraulic lift systems.
5.  Damage or defects resulting from, or repairs required because of, misuse, including, but not limited to overloading (as determined by the gross vehicle weight rating and not payload capacity as shown on the vehicle identification label), improper loading, negligence, alteration, accident or lack of reasonable and proper periodic maintenance.
6.  Corrosion to the frame, skin, electrical, or other construction materials caused by the presence of any product causing a chemical reaction to the materials used to build the trailer (fertilizers, cement, caustic chemicals, etc.).
7.  Replacement of maintenance items that are worn out from normal use, including, but not limited to bearings, magnets and brake shoes.
8.  Deterioration of paint and appearance due to use and exposure.
9.  Damages caused by loose or improperly torqued lug nuts.
10. Damages caused by the use of an incorrect or altered hitch ball or improper latching.
11. Damages caused by loose nuts, bolts or screws.  Maintaining necessary tightness of these items is the owner’s responsibility.
12. Loss of time, inconvenience, loss of use of trailer, rental of substitute equipment, loss of revenues, or other commercial loss.
13. Damages caused to trailers under 10,000 pounds GVWR that are towed by any vehicle that exceeds a one (1) ton towing capacity.
14. Damages caused by the use of a towing vehicle with a trailer that exceeds the tow vehicle manufacturer’s specific limitations.
15. Damages to any tow vehicle.
16. Tow vehicle wear.


ANY EXPRESSED OR IMPLIED WARRANTY NOT PROVIDED HEREIN, INCLUDING WITHOUT IMPLIED LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY REMEDY FOR BREACH OF CONTRACT, WHICH BUT FOR THIS PROVISION MIGHT ARISE BY IMPLICATION OF OPERATION LAW, ARE HEREBY EXCLUDED AND DISCLAIMED.  IF THEY CANNOT BE DISCLAIMED, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO A TERM OF ONE (1) YEAR.  SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.  UNDER NO CIRCUMSTANCES SHALL PACE AMERICAN BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, TORT OR OTHERWISE.  SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, THIS LIMITED WARRANTY IS LIMITED TO REPAIR OR REPLACEMENT AND IF SUCH WARRANTY FAILS BECAUSE ATTEMPTS AT REPAIR ARE NOT COMPLETED WITHIN A REASONABLE TIME, OR IT FAILS FOR ANY OTHER REASON, ANY DAMAGES ARE LIMITED TO THE LESSER OF EITHER THE COST OF NEEDED REPAIRS OR REDUCTION IN THE MARKET VALUE OF THE TRAILER CAUSED BY LACK OF REPAIRS, IN ANY CASE. 
PACE AMERICAN neither assumes nor authorizes any person to give any other warranty or to assume on its behalf any other obligation or liability.  This warranty is non-transferable from original end user.

Southern Sales:
Plant Location: Travelers Rest, South Carolina

Southern Sales, Inc., hereinafter referred to as manufacturer, unconditionally warrants each trailer to be free from defects in material and workmanship for a period of (12) months under normal wear and rated load capacity. The warranty begins on the date that the trailer is put into service with a limit of two years from shipment from the manufacturer. The warranty applies to all trailers that have not been altered or repaired without the manufacturer’s authorization. 


ITEMS WARRANTED BY RESPECTIVE MANUFACTURER
All axle assemblies, brake systems, wheels, tires, light systems, hitch couplers, jacks, power units, cylinders, or other accessories or purchased parts are warranted by the respective manufacturer.


NOT WARRANTED
The warranty does not cover: Customer dissatisfaction, transportation to and from the servicing dealer, lack of maintenance, accidents or operator’s misuse. SSI will not be liable for damages to any vehicles, property, or personal injuries involved in any type of accident. 

Stehl Tow

LIMITED WARRANTY:  Please read the warranty carefully.  It is a “Limited Warranty” as defined in the U. S. Consumer product warranty.  This warranty gives you specific legal rights and you may also have other rights that vary from state to state within the U. S.

STEHL TOW RESPONSIBILITY:  For 1 (one) year from date of purchase Stehl Tow will replace or repair at its option any part defective in material or workmanship.  The customer must return the defective part and pay any transportation charges to and from Stehl Tow.  Stehl Tow may offer at its discretion, a complete unit warranty swap and the cost will be prorated to the owner.  TOW DOLLIES USED FOR REPOSSESSION HAVE A LIMITED 90 DAY WARRANTY.  WIRING AND LIGHTS HAVE A LIMITED 30 DAY WARRANTY.

OWNER RESPONSIBILITY:  Warranty begins on the date of customer’s purchase from an authorized representative.  For your convenience keep the dated bill of sale.  Please fill out and mail your “Owner Registration Card” and a copy of sales receipt within 15 days of purchase. 

NOT COVERED BY LIMITED WARRANTY:  The following items are not covered by limited warranty: tires and rims, wheel bearings, hitch coupling latch assembly on dolly and tie down straps. 

NOTICE:   In order for this limited warranty to be in effect, the “Owner Registration Card” must be completed by original owner within 15 (fifteen) days of original purchase and returned to Stehl Tow Sales Co. together with a copy of the sales receipt.  Mail “Owner Registration Card” to: Stehl Tow, LLC, P. Take 3 Trailers, Inc.:

WHAT IS COVERED BY WARRANTY
Take 3 Trailers (Take 3) expressly warrants to you, the original purchaser of a trailer manufactured by Take 3, that on the date of purchase by you, the product was free from defects in the composition of materials  and workmanship and was in accordance with the industry standards of such products.  This warranty covers the main trailer structure, consisting of side rails, floor cross members, sub frame and all other parts manufactured by Take 3 that attach to the main trailer structure. 
 
LIMITED PAIN WARRANTY
Take 3 Trailers, Inc. warrants its paint finish to be consistent with industry standards for one year after the date of original retail purchase with the exceptions of “normal use” limitations set forth below and deterioration due to use or exposure, such as chipping, scratching, fading, road salt or tar, damage by animals or pressure washing.  Warrantable paint repairs are limited to spot repairs and blending consistent with standards in the trailer industry.
 
YOU MUST SEND US THE SIGNED STUB OF THIS WARRANTY
In order to validate this Limited Warranty, the original stub of this form, signed by the dealer and the purchaser, must be postmarked and mailed to: Take 3 Trailers, Inc., 2007 Longwood Drive, Brenham, TX  77833 no later than ten (10) days following the purchase of your Take 3 trailer.  IF THIS SIGNED WARRANTY IS NOT POSTMARKED BY THE TENTH DAY AFTER PURCHASE OF THE TRAILER, ALL EXPRESS WARRANTIES CONTAINED IN THIS LIMITED WARRANTY SHALL BE NULL AND VOID.  Please make a copy of the stub for your records.
 
DURATION OF THIS WARRANTY AND NOTICE REQUIREMENTS
This limited warranty is applicable to defects in components manufactured by Take 3 (which are not excluded in section 8 of this limited warranty) and which defects are discovered within a period of one (1) year in the case of the main trailer structure and all other parts manufactured by Take 3, that attach to the main trailer structure, from the purchase date indicated on the stub of this limited warranty.  For warranty service, contact the Take 3 dealer form whom you purchased the trailer or the Warranty Manager at Take 3.
 
WARRANTY TRANSFER
This warranty is transferable only within the original warranty period.  Transferee will receive balance of the remaining original warranty period.  This warranty can be transferred one (1) time only.  Trailer must pass inspection by the Warranty Manager at Take 3 in Brenham, Texas prior to warranty transfer.
 
REMEDIES AVAILABLE FROM TAKE 3
In the event of a defect in material or workmanship covered by this warranty, Take 3, in its sole discretion will:
(A.)  Correct the defective work or replace the defective parts on a no-charge basis at the Take 3 plant in Brenham, TX.,
(B.)  Reimburse the original purchase by paying a sum not exceeding the price charged by Take 3 for such work or parts, or,
(C.)  Provide for repair of the defect or replacement of the defective parts by an authorized Take 3 service shop.
 
REMEDIES NOT AVAILABLE FROM TAKE 3
The obligations stated in the preceding paragraph are the SOLE AND EXCLUSIVE REMEDIES available from Take 3, in the event of issues with the product manufactured by Take 3, Take 3 will not be liable for any special, incidental or consequential damages based upon breach of contract, negligence, strict liability in tort, or any other legal theory.  Take 3 reserves the right to make changes in design or make additional and/or improvements to its products without being obligated to make similar installation or modifications to products covered by this warranty. 
 
WHAT IS NOT COVERED BY THIS WARRANTY
This limited warranty does not cover:
(A.)  Damage or loss caused, in whole or in part, by failure to check and torque lug nuts properly,
(B.)  Damage or loss caused, in whole or in part, by accident or negligence or by the abuse, misapplication or misuse of the trailer or any of its component parts,
(C.)  Any transportation charges to or from factory or service center,
(D.)  Normal wear items due to wear.  These items include, but are not limited to, bearings, brakes, brake linings, wiring, ramps, tires, wheels and hoses,
(E.)  Items which are not manufactured or constructed by Take 3 Trailers, Inc., including but not limited to assembled axles, coupler, jack assembly/landing gear, wheels, tires, hydraulic systems, winches and air brake systems.  If these items are warranted by the manufacturer or supplier thereof, and such warranty may be extended to the original purchaser, Take 3 will make such warranties available,
(F.)  Damage or loss caused in whole or in parts by acts of nature,
(G.)  Any consequential or incidental damages incurred as a result of any defects, to include loss of time, inconvenience, loss of use of vehicle or any other fees incurred by purchaser relating to any warranty claim.
 
TRANSPORTATION COSTS EXCLUDED
Transportation of any trailer to and/or from your dealer or any approved repair facility shall be the responsibility of the trailer owner.  Take 3 Trailers, Inc. shall not be liable for any such costs.
 
WHAT WILL VOID THIS WARRANTY
(A.)  MISUSE, NEGLECT, OVERLOADING, UNAUTHORIZED REPAIR, ALTERATIONS, OR FAILURE TO PROVIDE NORMAL MAINTENANCE SHALL VOID THIS WARRANTY,
(B.)  Weights, dimension, capacities and other measures stated in connection with a trailer are only estimates and are not covered by this warranty,
(C.)  Any modification, alteration or repair to any product manufactured by Take 3 Trailers, Inc. without Take 3’s prior knowledge and consent will void manufacturer’s warranty. 
 
NO OTHER WARRANTIES
THIS AGREEMENT IS A COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOU AND TAKE 3 TRAILERS, INC. CONCERNING THE ALLOCATION OF THE RISKS OF DAMAGE OR LOSS ARISING FROM COMPONENT DEFECTS.  THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INLCUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS AND NO ONE IS AUTHORIZED TO MAKE FURTHER OR ADDITIONAL WARRANTIES ON BEHALF OF TAKE 3.
 
ALLOCATION OF RISKS
THIS AGREEMENT ALLOCATES THE RISKS OF DAMAGE OR LOSS ARISING FROM PRODUCT DEFECTS BETWEEN TAKE 3 AND PURCHASER AND THIS ALLOCATION IS RECOGNIZED BY BOTH PARTIES.
 
DEALERS RESPONSIBILITIES
Take 3 Trailer’s dealer is responsible for “dealer prep” which includes checking all cosmetic features and repairing all minor problems without charge to you or the manufacturer.
 
Your dealer is also responsible for submitting to the manufacturer any claim you may wish to make under the terms of the Limited Warranty.
 
REQUIRED WARRANTY CLAIM PROCEDURE
1.  In order to validate this Limited Warranty the original stub of this form, signed by the dealer and purchaser, must be postmarked to Take 3 Trailers, Inc. no later than ten (10) days following the purchase of your Take 3 Trailer.  IF THIS SIGNED WARRANTY IS NOT POSTMARKED BY THE TENTH DAY AFTER PURCHASE OF THE TRAILER, ALL EXPRESS WARRANTIES SHALL BE NULL AND VOID. 
 
2.  Within five (5) days after discovering a problem with your Take 3, return your trailer for inspection to your Take 3 Dealer where you bought the trailer.  Dealers are responsible for fixing minor problems without charge to you or the factory.
 
3.  If your dealer cannot repair the problem free of charge and you want to file a claim under this Warranty, your local dealer must phone or send to Take 3, by registered letter or fax, a limited warranty claim, together with all required information within 10 days of your discovery of the defect.
 
4.  Take 3 Trailers, Inc. will acknowledge such receipt of claim by phone, registered letter, or fax to the dealer and to the claimant.  Take 3 will respond as soon as possible, but no later than thirty (30) days after receipt of the claim. 
 
5.  Any defective part(s) must be sent by prepaid freight to Take 3 Trailers, Inc. in order to qualify the claimant for replacement or reimbursement under this Limited Warranty.  ANY DEFECTIVE PARTS MUST BE RETURNED TO TAKE 3 TRAILERS WITHIN 30 DAYS FROM DATE OF APPROVAL OF CLAIM TO QUALIFY FOR REIMBURSEMENT.
 
6.  Take 3 will not reimburse any claimant for any adjustment or repair of your Take 3 Trailer without prior approval by Take 3. 
 
7.  If you return your trailer to the factory, we will warrant the repair or replacement parts for a year from the date of repair.  If authorized repair must be done other than at the factory, Take 3 will not warrant such repair or replacement parts.
 
8.  Take 3 reserves the right to not pay unreasonable costs for replacement or repair of defects in your Take 3 trailer and may, at its discretion, establish a reasonable reimbursement for any authorized work performed under the terms of this Limited Warranty. 
 
TAKE 3 TRAILERS, INC. MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES AND THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE  DESCRIPTION ON THE FACE OF THIS LIMITED WARRANTY.
